Decorative Concrete Terms & Conditions
A. CONCRETE STRENGTH AND ADDITIVES
The company will not be liable for, and will be indemnified by the purchaser in respect of, any claims made by the purchaser or any third party arising out of any defects in the concrete that result from:
- Faulty handling, placing, or cutting of the concrete by the purchaser, its sub-contractors, or any other person.
- The addition of excessive water or non-approved materials to the concrete either before or after discharge from the delivery unit.
- The addition of any additives at the purchaser’s request or instruction that are not approved by the company.
The concrete strength is shown on the face of the delivery docket. Upon signing, the purchaser is bound by the information shown. Purchasers must ensure the strength shown meets the required specification.
B. DELIVERY
The Company is not liable for delays or non-delivery due to transport issues, plant breakdowns, material shortages, industrial stoppages, or other causes beyond its control.
Delivery must be accepted and discharge completed promptly upon arrival. If discharge takes longer than 45 minutes or 10 minutes per cubic metre (whichever is greater), waiting time will be charged at the Company’s standard rates.
Delivery is made to kerbside only. If the vehicle enters the job area or neighbouring property at the purchaser’s request, the Company is not liable for any resulting issues and is indemnified by the purchaser.
C. PRICE AND PAYMENT
Charges are based on quantities listed on the delivery docket. Signing the docket confirms agreement; no short delivery claims will be entertained.
Payment must be made before delivery or within an agreed credit period. Late payments accrue interest at the ruling bank overdraft rate from invoice date. Payments are applied first to interest.
If an order is cancelled, the purchaser must pay all costs incurred by the Company up to cancellation. The Company’s cost assessment is binding.
D. GENERAL
“Purchaser” includes their employees, agents, and subcontractors. Actions or signatures by anyone appearing to act on behalf of the purchaser bind the purchaser.
All warranties or undertakings not explicitly stated are excluded (unless exclusion is prohibited by law). These are the sole contract terms unless altered in writing by an authorised Company representative.
If any concrete is defective, the Company’s liability is limited to replacement only. No liability for consequential loss or damage is accepted.
Concrete is supplied with the assumption the purchaser/client has exercised due diligence regarding product characteristics and has reviewed the ‘Decorative Concrete Information’ on the Company’s website.
Variations or imperfections (e.g., colour changes or impurities) in quarried materials are natural. The Company is not liable for such issues and assumes the purchaser has accounted for these in their selection.
